GEI 2016 Moot Court Competition Clarifications to the Brief to Counsel The following clarifications have been agreed to by both parties. Except for corrections, the clarifications are supplementary to the Brief to Counsel. Any request for clarifications which are not addressed in the following paragraphs have been considered by the parties to be redundant, immaterial or matters for which the parties are not able to agree on. Correction: 1. The name Jenny in paragraph 2 of page 3 should be replaced to Jenna. Clarifications: 2. The “system” mentioned by Aurelien in paragraph 2 of page 3 refers to the professional development scheme applicable to employees in the sales department. 3. Jenna is a Sales Manager at HatStreet UK Pte Ltd. Sales managers oversee sales for a particular district in the country. 4. Jenna has worked with HatStreet UK Pte Ltd for 11 years. 5. In Hatstreet UK Pte Ltd, mistakes committed by employees are treated on a case by case basis depending on the gravity of the said mistake. Mistakes may amount to misconduct, depending on the effect and scale of the mistake. 6. The disciplinary hearing has been adjourned pending the outcome of the suit. Parties are to pray for the hearing to be resumed, or for the notice of disciplinary hearing to be rescinded. 7. Candace and Philip were the only eligible candidates for the Sales Manager position before Philip was promoted. 8. When Candace intended to go to the EHRC on 9 December 2015, she was planning to ask for advice. 9. Hatstreet UK Pte Ltd was the appellant at the Employment Appeal Tribunal stage as well as at the Court of Appeal. Candace cross-appealed on the sex discrimination issue.
