BEHAVIOR ASSISTANT CONTRACTOR AGREEMENT
THIS AGREEMENT made this _______ day of _______________, 20______, by and between ______________________________________, hereinafter called the Contractor, and ABA Solutions, Inc, hereinafter called the Owner. WITNESSETH, that the Contractor and the Owner for the consideration named herein agree as follows:
ARTICLE 1. SCOPE OF THE WORK
The Contractor shall provide one-on-one activities related to the delivery of behavior analysis services as defined in the behavior analysis service plan. Activities include coaching parent/staff on procedures, implementation of behavioral procedures for acquisition of replacement skills and reduction of problematic behavior, conducting proficiency checklists, collecting data on behaviors in BASP, and weekly contact with behavior analyst on case. Write quarterly/annual summaries and possible graphing of data.
ARTICLE 2. THE CONTRACT PRICE
The owner shall pay the Contractor for the services performed under the Contract at the hourly rate of Thirteen dollars and forty cents ($13.40) per hour or $3.35 per unit (15 minutes) for Medicaid Waiver consumers. Reimbursement rates for all other funding sources are variable and are listed in the Reimbursement Schedule. If there is a funding source that has a negotiable rate, it will be presented to the contractor and a verbal agreement will be reached between both parties.
ARTICLE 3. PAYMENTS
Billing is due every other Saturday unless notified otherwise. Billing turned in after Sunday night of the billing week will not be processed with the current billing cycle and will need to be resubmitted with the next billing cycle.
Checks: The owner shall mail a check to the contractor the second Thursday after the billing due date. Direct Deposit: Funds will be available in the contractors account on the third Wednesday after the billing due date. If there is a holiday, then funds will be available on Thursday instead of Wednesday.
MedWaiver: If the service authorization (SA) is not approved, the contractor is not required to provide services. The contractor will be able to continue working while services are pending if the contractor chooses to, however they may not be paid for their services.
If the contractor exceeds the average number of monthly units on the service authorization (SA), and the money is recouped, owner will recoup that money from contractor. Contractor will not be paid for billing that exceeds the total units authorized on the quarterly SA,
If it becomes necessary to put a consumer’s services on hold due to payment issues, the owner will pay the contractor for all services rendered up to the point when services were placed on hold. If the contractor works after services have been placed on hold then contractor works at their own risk and payment may not be provided if the payment for services after the date they have been placed on hold is not rendered.
In the event owner shall fail to pay any periodic or installment payment due hereunder, contractor may cease work without breach pending payment or resolution of any dispute. However, owner reserves the right to withhold payment if all terms of service are not satisfied as required by the provider handbook/ABA Solutions contract, including, but not limited to turning in monthly graphs and quarterly/annual summaries after the 21st of the month. If payment is being withheld, contractor will be given a notice with an expectation of what must be submitted in order to receive payment.
ARTICLE 4. GENERAL PROVISIONS
All work shall be completed in a professional manner and in compliance with the Behavior Assistant code of ethics.
Contractor shall furnish materials (e.g., paper, computer, cell phone, etc.) necessary to provide behavior assistant services.
Contractor must provide the owner with at least 30 days notice prior to terminating work with any consumer.
Proof of qualifications, as well as other new hire documentation must be provided prior to the contractor working with any consumers.
The contractor will be responsible for completing, maintaining and updating all trainings required by APD (Agency for Persons with Disabilities) or other funding source. The owner will notify the contractor of the specific trainings that he/she needs to complete and trainings will be completed within the timeframe specified. If trainings are not completed within the specified time frame, contractor will be suspended from providing services to consumers pending the completion of the trainings.
Monthly graphs, Quarterly/Annual Summaries will be turned in by the 10th of each month.
All staff meetings are mandatory. The owner will notify the contractor at least two weeks in advance of any staff meeting.
All of our documentation is proprietary and can only be used with ABA Solutions, Inc clients. Any usage of our documents with non-ABA Solutions, Inc clients is considered a violation of this rule and subject to termination and potential legal action.
