Details of False Arrest
Tuesday 29th March 2016
I received a telephone call from Sergeant Mark Daly of Charleville Garda Station. Mr Daly wanted me to attend Charleville Garda Station to pay an outstanding parking fine.
We mutually arranged that I would attend the Garda station at 10am on Thursday morning at 10am. Garda Daly instructed me to meet him personally at the station.
Thursday 31st March:
I attended Charleville Garda station and met with Garda Nick Phealan who informed me that Garda Daly was running late. I explained I was on my way to Limerick and I would call back at 1pm to meet with Garda Daly.
On my return from Limerick I got a call from Mark Daly asking me to confirm that I was definitely calling to meet him at 1pm. I assured him I was only five minutes away. I call into the Garda station at 12.50pm and was met with Garda Daly Standing in the main entrance outside the front desk. I paid over the money for the parking fine and then Garda Daly informed me that they were two Garda from Kenmare waiting in the station to speak to me about an alleged fraud I had committed in 2008.
Garda Daly invited me inside the counter where I met two uniformed Garda. They introduced themselves as Garda Sean Regan and Garda Sean Twomey. The advised me that I was now under arrest and they were removing me to Mallow Garda Station. I asked if I could call my sixteen-year-old daughter who was home alone and would have been expecting me home. When I told my daughter what was happing she got very distressed. The Garda on duty at the station Nick Phelan logged my arrest details into the station log book. They told me I had two options I could allow one of them to drive my car so that I could make my way back or I could choose to get a bus back home.
I was taken in the Garda Squad car driven by Garda Regan and conveyed to Mallow Garda Station. We arrived in Mallow Garda station at approximately 1.15pm. I was booked into the custody suite and I was asked to remove my all my personal belongings and put into a Garda cell. Sometime later I was brought into the interview room and interviewed by Garda Regan and Garda Twoomey. When the interviewed finished I was returned to the cell and waited for some time. I was then brought out of the cell again and I was photographed and fingerprinted. I was released at approximately 4pm where I drove my own car home.
