Design work, repair work or supply of services outside of the specification, house washing, rubbish removal, cleaning of premises, removal & replacement of furniture, window dressing, or personal belongings is separate to and not part of the total price above unless otherwise stated. These services can be supplied at a separate charge.
1 The contractor is entitled to reasonable extensions of time if the cause of delay to the work is beyond the contractor’s control. The contractor and client must take all reasonable steps to minimise delays to the work if extension of time is claimed, the contractor must give the owner / client in writing or e-mail the extra time required and the cause of the delay.
2 Total contract price, Deposit and Progress payment, refer to schedule of payments. All payments payable within ( 5 ) days of written notice from the contractor.
3 Variation to scope of works or specification. The work to be performed and the materials to be used and the contract price varied accordingly only if agreement to the variation is recorded in writing or via e-mail. Any consequent variation in the agreed completion date must also be agreed in writing or via e-mail..
4 Standard of work and materials. The contractor will carry out the work in a workmanlike manner complying with the requirements of the Building Code of Australia. All materials and components supplied will be of a quality fit for the purpose intended and unless otherwise stated, new.
5 Furniture and fixtures. The owner / client must remove any furniture, fixtures, window dressings or personal goods from the vicinity of the work ( charged as a variation ) as this time is not calculated into quote and to minimise the risk of damage. The contractor will not be responsible to damage caused to such goods left in the vicinity of work.
6 Hours of work. The owner / client must give the contractor, the contractor’s employees and sub contractors access to the site of the work to carry out the work during usual working hours (8.00 am till 4.30 pm) or those agreed to. The owner / client must not impede the contractor’s work. The owner / client must give notice in writing or via e-mail and manage other trade work carried out in the vicinity of the painting and decorating work, so as to not impede the contractor or cause lost time to the contractor. Lost time will be charged as a variation after notification in writing or via e-mail to the owner / client.
7 Clean up. The contractor will remove from the site all rubbish and surplus material. Surplus material will be the property of the contractor. Site to be left to a reasonable standard of cleanliness.
8 Termination of the contract. If the owner / client fails to make a payment to the contractor within ( 7 ) business day of the due date, becomes bankrupt, goes into liquidation, fails to make a due payment or denies the contractor access to the site to carry out the work then the owner / client will be considered to be in default and the contractor may issue a notice in writing or via e-mail demanding that the owner / client remedy the default within ( 10 ) business days. If the fault is not remedied, the contractor may give written notice via e-mail that the contract is terminated.
9 Warranties. The contractor warrants that.
a) The work will be performed in a workmanlike manner, in accordance with the description of works detailed in this contract.
b) All materials supplied by the contractor will be suitable for the purpose for which they are used and of good quality as specified.
c) The work will be done in accordance with and will comply with the Home Building Act of NSW.
d) The work will be done with due diligence and within the time stipulated in the contract or if no time is stipulated within a reasonable time.
e) Claims against warranties covering painting and decorating works must be made within two years of the completion of the works.
f) It is assumed that all substrates and previous coatings are sound and in good condition unless otherwise noted. It is assumed level of finish of cement render, plasterboard and other substrates are up to standard for the intended decoration.
10 Labour only work will be charged at $40 per hour plus materials supplied plus 25% of purchase price.
11 Variations to specified work and colour design (change of colour ) will be be charged at the rate of $45 per hour plus materials supplied plus. Additional colour consult will be charged at $200 per site visit. Changes to colour scheme as specified will incur a change to contract price.
12 Travel or set up allowance will be charged at the rate of one hour where hours charged for the day are less than eight.
13 Materials and services supplied will be charged at invoice plus 25 %.
14 This contract is viewed as valid if not signed by the nominated person once site access has been given for work to start and work has started.
